Texas Senate Candidate James Talarico Faces Scrutiny Over Stance on Federal LGBTQ+ Equality Act

On Friday, October 9, 2026, Texas Democratic U.S. Senate nominee James Talarico drew national attention after his campaign initially hesitated to reaffirm a prior commitment to co-sponsor the federal Equality Act. The proposed legislation seeks to extend civil rights protections by prohibiting discrimination based on sexual orientation and gender identity in housing, employment, and public accommodations nationwide.
According to LGBTQ+ news outlet The Advocate, citing an investigation by The Washington Post, Talarico had signed a pledge in 2025 during the Democratic primary for advocacy organization Stand for Children, committing to co-sponsor the Equality Act if elected to the Senate. However, when asked by reporters during the general election campaign whether he still intended to co-sponsor the bill, his campaign initially stated that the candidate would “review each piece of legislation and do what is best for the people of Texas.” Following the publication of the Washington Post report, a campaign spokesperson clarified that Talarico continues to support the Equality Act policies outlined in the questionnaire.
In recent months, Talarico, currently a member of the Texas House of Representatives, has struck a moderate tone on several sensitive issues while campaigning to win over undecided voters. In interviews with Fox News and on several podcasts, he stated that he opposes transgender women participating in female sports divisions if it compromises athletic fairness or safety, and expressed opposition to gender-affirming surgeries for minors. At the same time, in 2023, Talarico voted against Texas legislation banning medical transition care for minors, maintaining that health care decisions should be made by families and medical professionals rather than state officials.
His Republican opponent in November, Texas Attorney General Ken Paxton, seized on the response to accuse Talarico of flip-flopping to deceive moderate Texas voters, characterizing his past record as far-left. Meanwhile, progressive activists and LGBTQ+ advocacy groups expressed frustration with the campaign’s cautious messaging, warning against yielding to conservative political pressure. According to aggregate polling data, Talarico holds a narrow lead of approximately 2.8 percentage points over Paxton in what has become one of the most competitive Senate races in Texas, where a Democrat has not won a U.S. Senate seat since 1988.
